Terms of Service

1. Acceptance of Terms

By accessing or using BeatTrees ("the Service"), operated by BeatTrees ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and BeatTrees.

2. Description of Service

BeatTrees is a beat discovery and market analysis platform that aggregates publicly available data from YouTube and TikTok. We provide trend analysis, saturation scoring, AI-powered insights, and producer analytics to help music producers and artists make informed decisions. The Service includes both free and paid subscription tiers.

3. Eligibility

You must be at least 16 years of age to use BeatTrees. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

  • You may register using email/password or Google OAuth. You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
  • You may not share your account or use another person's account without their permission.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.

5. Connected Third-Party Accounts

You may optionally connect your YouTube and/or TikTok accounts to BeatTrees. By connecting these accounts:

  • You authorize BeatTrees to access your channel/account metadata, video data, and analytics through their respective APIs.
  • You understand that your use of YouTube data is also subject to YouTube's Terms of Service and Google's Privacy Policy.
  • You understand that your use of TikTok data is also subject to TikTok's Terms of Service.
  • You may disconnect these accounts at any time via Settings, which will delete all stored tokens and fetched data.

6. Subscriptions & Payments

  • BeatTrees offers Free and Pro subscription tiers. Pro includes a 7-day free trial for new subscribers.
  • Pro subscriptions are billed through Stripe on a monthly or yearly basis at the prices displayed on the pricing page at the time of purchase.
  • Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel at any time; access continues through the end of the current billing period.
  • We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current billing period.
  • Refunds are handled on a case-by-case basis. Contact support@beattrees.ai within 14 days of a charge for refund requests.
  • If payment fails, your account may be downgraded to the Free tier after a grace period.

7. AI Features

  • BeatTrees provides AI-powered features including an AI consultant, AI search, beat analysis, SEO optimization, and market reports, powered by Anthropic's Claude.
  • AI responses are generated based on available market data and should be treated as informational suggestions, not professional advice.
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
  • AI usage is subject to plan-based limits: Free users receive 3 AI consultant messages per day and 5 AI searches per month. Pro users have unlimited access.
  • You may not use AI features to generate content that is illegal, harmful, or violates third-party rights.

8. Acceptable Use

You agree not to:

  • Scrape, crawl, or bulk-download data from BeatTrees using automated tools
  • Attempt to reverse-engineer our scoring algorithms, AI prompts, or proprietary systems
  • Use the platform for any unlawful purpose or to facilitate illegal activity
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Circumvent rate limits, usage quotas, or access controls
  • Impersonate another user or misrepresent your affiliation with any person or entity
  • Upload or transmit malicious code, viruses, or harmful data
  • Use the Service to compete directly with BeatTrees without written permission

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

9. Intellectual Property

  • The BeatTrees platform, including its design, logos, scoring algorithms, AI features, and all original content, is the property of BeatTrees and is protected by intellectual property laws.
  • Beat content, thumbnails, and channel data displayed on the platform belongs to the respective YouTube/TikTok creators and is governed by each platform's Terms of Service.
  • Your user-generated content (collections, saved items, alert configurations) remains yours. You grant BeatTrees a limited license to store and display this data as necessary to provide the Service.

10. Disclaimer of Warranties

BeatTrees is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Specifically:

  • We do not guarantee the accuracy of market data, velocity scores, saturation metrics, or trend predictions.
  • We do not guarantee uninterrupted or error-free access to the Service.
  • AI-generated content may contain inaccuracies and should not be relied upon as sole basis for business decisions.
  • Data from YouTube and TikTok may be delayed or incomplete due to API limitations.

11. Limitation of Liability

To the maximum extent permitted by applicable law, BeatTrees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amounts paid by you to BeatTrees in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless BeatTrees, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Account Termination

  • You may delete your account at any time via Settings > Danger Zone. This permanently removes your data within 30 days.
  • We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law.
  • Upon termination, your right to use the Service ceases immediately. Any outstanding subscription fees remain due.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration, except where prohibited by law.

15. Changes to These Terms

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email or in-app notification. Continued use of BeatTrees after the effective date of changes constitutes acceptance of the updated Terms. If you disagree with the changes, you may close your account before they take effect.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
